Terms of Service

1. Acceptance of Terms

By downloading, installing, or using BerriPay ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Service Description

BerriPay enables individuals and families to accept payments using tap-to-pay technology on their mobile devices. The App integrates with Stripe Connect and Stripe Terminal to process payments. BerriPay is not a financial institution and does not directly handle, store, or process payment information.

3. User Responsibilities

• You must be at least 18 years old to create a primary account
• You are responsible for all activities under your account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your device and account
• You must comply with all applicable laws and regulations
• You are responsible for any taxes related to payments you receive

4. Family Sharing

Primary account holders may add family members to their account. The primary account holder is fully responsible for:

• All transactions made by family members
• Setting and monitoring spending limits
• Ensuring family members comply with these terms
• Any disputes arising from family member activities

5. Payment Processing

All payment processing is handled by Stripe. By using BerriPay, you also agree to Stripe's terms of service. BerriPay is not responsible for:

• Payment processing errors or failures
• Disputed transactions or chargebacks
• Delays in fund transfers
• Currency conversion rates or fees
• Any issues arising from Stripe's services

6. Fees

BerriPay charges a percentage fee plus a fixed amount per transaction. Current fees are displayed in the App. We reserve the right to change fees with 30 days notice. Stripe may charge additional fees for certain services.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERRIPAY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS ARE NOT LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the service
• Any damages resulting from the use or inability to use the service
• Any damages related to payment processing or financial transactions

8. Indemnification

You agree to indemnify, defend, and hold harmless BerriPay and its affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App, violation of these terms, or violation of any rights of another party.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Termination

We may terminate or suspend your account at any time without prior notice or liability. Upon termination, your right to use the App will immediately cease. All provisions which by their nature should survive termination shall survive.

11. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
